Overview of the recording of personal data

This overview states which personal data the courts (courts of justice, tribunals, Administrative High Court and the Board of Appeal for the Business Community) record and with which parties that data is shared.

The examining magistrate has access to data for investigation purposes.

The parties to the proceedings such as the Public Prosecution Department, lawyers, attorneys, suspects, victims, injured parties, witnesses and experts exchange data in the context of the court case.

The court may make the judgment available to third parties if necessary for the execution of the judgment. On the basis of the ❌press guidelines (Dutch) the court may share a limited amount of data with registered journalists.

Transmission of data to countries outside the European Union

Under mutual assistance treaties, personal data may be transmitted to judicial authorities of countries outside the European Union.

The courts process data in order to keep the registers listed below updated. This is a statutory obligation of the court.

National roll of lawyers:

  • Lawyers: name and address details; correspondence address; contact details; date and place of birth; details about death; gender specification; status lawyer; start date status lawyer; date first sworn in; characteristic professional party; firm details; financial details.

Central Insolvency Register:

  • Natural persons: name and address details; place of residence; correspondence address; date and place of birth; capacity in proceedings; case number; insolvency number; debt restructuring number.
  • Legal entities: name and address details; correspondence address; Chamber of Commerce number; capacity in proceedings; case number; insolvency number; liquidation reports.
  • Liquidator: name and address details; correspondence address; contact details; titles; capacity in proceedings.

Register of prenuptial agreements:

  • Registered partners: name and address details; date marriage/registered partnership; marriage location; registration number; type of registration (prenuptial agreement or partnership agreement); the court where the prenuptial agreement or partnership agreement is registered and can be inspected; the date on which the request for registration was submitted; the date of entry in the matrimonial property register; prenuptial agreement or partnership agreement.

Central Guardianship and Administration Register:

  • Data subjects: name and address details; date and place of birth; capacity in proceedings; case number; registration card number; publication date; reason for guardianship or administration; start date.
  • Guardian, administrator: name and address details; place of residence; correspondence address; titles; capacity in proceedings; case number.

Successions register:

  • Deceased: date of birth, date of death, name, address, most recent place of residence;
  • Heirs: name and address details.
  • Civil-law notary: name and address details.

Custody register:

  • Children placed in the custody: name and address details; date and place of birth; details of death; citizen service number; capacity in proceedings; case details; registration date; date of decision; characteristic; substantive decision.

Other recording of personal data

Register of secondary occupations of judicial officers

This register records data concerning the professions and secondary occupations of the members of the judicial authority entrusted with jurisdiction. Visitors can access the register at Rechtspraak.nl. The purpose of this register is to publish data concerning the professions and secondary occupations of the members of the judicial authority entrusted with jurisdiction.

No personal data is actively transmitted abroad. Due to the public nature of the register, the data can be consulted from abroad.

Digital Docket

The Digital Docket provides the legal profession with a schedule of the cases to be heard at Rechtspraak.nl. 
The purpose of the processing is to provide lawyers with electronic access to their own case data on the courts’ civil case dockets.

  1. Selection procedure for trainee judicial officers

    Data is processed in a database system and the associated files to select applicants for appointment as trainee judicial officers. The purpose of the processing is to optimize the selection procedure.

    Applicants: name, address, date of birth, place of birth, background, test results, references, opinions, recommendations.
    Members of selection committees: name, address, position.

    Members and secretaries of the selection committee, the Study Centre for the Administration of Justice (SSR), court presidents.

  3. Procedures for recommendation for appointment of members of a board of a court

    Data is processed in a database system and the associated files to select applicants for appointment or reappointment as chairmen/members of a board of a court. The purpose of the processing is to optimize the selection procedure for the members of boards of courts.

    Applicants/candidates: name, address, date of birth, place of birth, background, test results, references, opinions, recommendation.
    Members of selection committees: name, address, position.

    Members of the Council, the office employees concerned, court presidents, advisory committee, Minister of Justice.

Mail registration system

The mail registration system and the associated mail archive processes data relating to correspondence that is not conducted as part of judicial proceedings or financial of personnel administration.
The purpose of the processing is to record and store incoming and outgoing mail for optimum operations and compliance with the Public Records Act.

Senders and recipients of the correspondence: name, address and all data included in the correspondence.

No personal data is transmitted from this system to locations outside the Netherlands. Correspondence may of course be sent abroad.

Video surveillance

​The public areas of the Dutch judiciary are under video surveillance. The images are deleted no later than 120 hours after the recordings have been made or observed incidents have been dealt with. The purpose of the processing is to monitor and protect persons and property in the public areas of the court building.
