Cost of international child abduction procedure

You must pay the court to process your request to return the child. This is known as court fees. Pay on time, check the court registry invoice for this. In addition, you will pay for a lawyer if you use one. It depends on your income and assets whether you can get government subsidy for the cost.

The fees for this procedure can be found in the table of court fees in civil cases.

Paying court fees

The court fees must be paid within 4 weeks. For petitions, this time limit applies from the date you filed the petition.

The date by which the court fees must be received by the court is mentioned on the court fees invoice, together with the IBAN of the court.

 

Special assistance for court fees

If you have a low income, you can apply to your municipality for special assistance for court fees. Your municipality determines whether you will receive the special assistance. For more information, contact your municipality.

 

Allowance for lawyer's fees

Are you unable to pay the costs of a lawyer or a mediator, or only partly? You may be entitled to a subsidy from the Legal Aid Board. How much subsidy you receive depends on your income and assets.


Additional costs besides court fees

You may have more costs, such as for a lawyer or for mediation. It depends on your income and assets whether you can get government subsidy for the cost. If you want crossborder mediation for a second time, this always involves extra costs.

If you want to attend the hearing yourself in the Netherlands, you may also incur travel and accommodation expenses. You can ask the court to order the other parent to pay all your costs.
