The Amsterdam Court of Appeal has confirmed the decision of the (first instance) judge in interim injunction proceedings, in which the request of EssilorLuxottica(EssiLux) for the exhibition of documents was rejected.
EssiLux and GrandVision have a dispute relating to the intended acquisition of GrandVision by EssiLux. In the opinion of EssiLux GrandVision did not comply with its obligation to conduct its business in the ordinary and usual way after the beginning of the COVID 19 pandemic. Arbitration proceedings regarding this dispute are pending between the parties. In these arbitration proceedings GrandVision and EssiLux agreed upon limited disclosure.
Given this agreed limited disclosure, EssiLux has insufficient rightful interest in the requested inspection or submission of documents to be provided by GrandVision. At this stage, there are insufficient grounds for further interim measures. Link naar Nederlandse versie van het persbericht
