The Noord-Holland Provincial Executive was right to grant a planning permit to Circuit Park Zandvoort, according to the judgement of the Noord-Holland Court. The permit allowed works to be carried out for the Formula 1 Dutch Grand Prix Event. The Court concludes that the planning permit does not lead to more nitrogen deposition. The permit granted by the Executive is upheld and the Court turns down the objections submitted by various environmental organisations. 


Permit granted

On 25 October 2019 the Noord-Holland Provincial Executive granted a permit to Circuit Park Zandvoort to use the race track terrain and carry out works on the grounds including placing temporary spectator stands, earthmoving, building two tunnels and reinforcing pedestrian access paths. 

Various environmental organisations, including Cooperation Mobilisation for the Environment U.A. and the Dutch Dune Conservation Foundation, raised objections to the permit. According to the environmental organisations, the use of the race track terrain and the works would result in increased nitrogen deposition. Moreover, the environmental organisations argued it was impossible to monitor the emission ceiling set by the permit and, therefore, there was a risk of exceeding that ceiling with negative effects for the ‘Kennemerland-Zuid’ Natura2000 Area.  

On 1 July 2021 the Court heard the objections and concluded the proceedings. On 12 July the court reopened the proceedings and requested STAB, the Dutch Foundation for Advice on Administrative Law, to start an investigation. The parties did not wish a follow-up hearing. On 22 March the Court again concluded the proceedings and today the Court passes a judgement.


Court Judgement

The Court determines that previously, throughout the whole year the race track terrain could be used for motor car and motor bike racing events and other major events, including Formula 1. 
The permit granted by the Executive limits the number of days the race track terrain can be used. The permit also sets an emission ceiling; previously, that was not the case.

Therefore, the Court concludes that nitrogen deposition and emission will be lower in the granted permit than previously allowed. As the permit does not lead to increased nitrogen deposition, the Court rules out the possibility that the use of the race track terrain and the execution of the works on the grounds may have significant effects for the nearby Natura2000 Area.  

The Court goes on to conclude that the registration system prescribed in the permit is sufficient to monitor the emission ceiling for any breaching. The court also deems all other arguments put forward by the environmental organisations insufficient to nullify the permit.
