Request for extradition of Chilean national to be found legally admissible

On March 30, 2022 the Dutch authorities received a request by the Chilean Authorities for the extradition of the Chilean national K.R.V. who was convicted on January 18, 2021 by a Chilean penal court, the Criminal Trial Court of Antofagasta, for crimes of fraud by a public official.

The Criminal Court of Rotterdam has judged this request in hearings in 2022 and 2023. Today the Rotterdam court has reached a decision in this case and – considering the boundaries of the competence of the court as dictated by Dutch and international law - has rendered the extradition of K.R.V. admissible.

Now the extradition is (legally) rendered admissible by the court, it is hereafter in the hands of the Minister of Justice to decide whether the requested person will be extradited to Chile. It should be noted that in an accompanying letter to the Dutch Secretary of Justice, the Rotterdam Court has given the Minister in consideration to await the outcome of the Dutch asylum procedure by the requested person and also to request for guarantees from the Chilean Authorities for the safety of the requested person upon return to Chile.
