But it need not be an either/or choice.<br></div><div>Parties who agree to arbitration under the rules of the Netherlands Arbitration Institute (NAI) may designate the Netherlands Commercial Court (NCC District Court or NCC Court of Appeal, as the case may be) as the appropriate chamber for any post-award - and sometimes even pre-award - court litigation. This would enable the parties, e.g., to file a setting-aside claim with the NCC Court of Appeal in English. Such legal actions no longer need to be dealt with in Dutch, saving the parties time and costs. <br></div>

The shares were pledged to Glas Trust Corporation Limited (United Kingdom). Pursuant to article 3:251(1) of the Dutch Civil Code, Glas sought an order permitting the sale of the shares to Yonderland Bidco BV (Belgium) in a private transaction. The application was filed on 18 February 2021. No hearing was held.</p>

This included the Palace of Justice of the Amsterdam Court of Appeal, where the <a href="/English/NCC/Pages/default.aspx">Netherlands Commercial Court </a>(NCC District Court and NCC Court of Appeal) are located. <br><br>NCC immediately <a href="/English/NCC/news/Pages/COVID19-NCC-is-open-for-business-but-restrictions-apply.aspx">alerted </a>the public to what this meant for NCC operations.<br><br>The closure of the courthouse did not materially affect NCC operations. We’ve been open for business since the outbreak of the COVID-19 virus. And we still are. <br> <br>Courthouses in the Netherlands are gradually re-opening. The NCC courthouse will be accessible to lawyers and parties effective 1 June 2020 if the court orders a courtroom hearing. However, <a href="/English/NCC/news/Pages/COVID19-NCC-is-open-for-business-but-restrictions-apply.aspx">some restrictions will still apply</a>, such as a maximum number of attendees. And in most cases members of the public will not be allowed to enter the courthouse. In the courthouse special precautions have been taken to minimise COVID-19 risks. <br> <br>What have we been doing in the last two months?<br> </p>

The shares were pledged to Glas Trust Corporation Limited as Security Agent for the lenders. Pursuant to article 3:251(1) of the Dutch Civil Code, Glas sought an order permitting the transfer the shares to the Stichting Continuïteit IHC in a private transaction. The application was filed on 4 May 2020 and a teleconference hearing was held on 12 May 2020. Representatives of and counsel for Glas, IHC Merwede, the Stichting Continuïteit, the majority shareholder and the Agents for the lenders attended the hearing.</p>
