The shares were pledged to Eagle Ultimate Global Holding BV (the pledgor). Pursuant to article 3:251(1) of the Dutch Civil Code (DCC), Credit Suisse (Singapore Branch) sought an order permitting the sale of the shares to the secured creditors in a private transaction.<br></p>

This enables the NCC to deal with IP cases which require a high level of specialist expertise. Due to the international nature of many IP cases and clients, the ability to litigate in the English language allows for direct interaction between parties, their lawyers and the court. But it need not be an either/or choice.<br></div><div>Parties who agree to arbitration under the rules of the Netherlands Arbitration Institute (NAI) may designate the Netherlands Commercial Court (NCC District Court or NCC Court of Appeal, as the case may be) as the appropriate chamber for any post-award - and sometimes even pre-award - court litigation. This would enable the parties, e.g., to file a setting-aside claim with the NCC Court of Appeal in English. Such legal actions no longer need to be dealt with in Dutch, saving the parties time and costs. <br></div>

Pursuant to article 3:251(1) of the Dutch Civil Code, Glas sought an order permitting the sale of the shares to Yonderland Bidco BV (Belgium) in a private transaction. The application was filed on 18 February 2021. No hearing was held.</p>
