On 1 January 2025, the Dutch Code of Civil Procedure (DCCP) was amended on several points. Most notably, the update includes a simplification and modernisation of the rules of evidence. To mark this occasion, the Netherlands Commercial Court (NCC) is holding an English-language seminar exploring how these changes may affect the resolution of international commercial cases. 

Speakers

Speakers include Professor Spamann of Harvard Law School (see bio below), who will take us through some of the myths and realities of common and civil law, and  Judge Jongeneel who will explore the possible impact of these new evidence rules on the resolution of large commercial cases. The seminar will conclude with a presentation on the updated English translation of the DCCP and the challenges the  authors encountered in its creation.

Professor Spamann

Professor Holger Spamann is a Professor of Law at Harvard Law School, where he teaches corporate law and corporate finance. His research focuses on the law and economics of corporate governance and financial markets, judicial behavior, and comparative law. Before embarking on his academic career, he practiced with a New York law firm and clerked for two years in Europe. He holds many degrees, among them a Ph.D. in economics from Harvard University. He is a member of the bar of New York and qualified for the German bar.

Judge Jongeneel

Han Jongeneel taught law at VU Amsterdam from 1986 to 1997 and completed his PhD thesis on general contract terms in 1991. He became a judge at the Amsterdam District Court in 1997 and has dealt with civil cases since 2000. His recent experience focuses on insurance, real estate, and competition cases, collective actions concerning mass damage and general civil cases. He is the chairman of the Expert group on Civil Procedure of the Dutch judiciary.

Judge Frakes

Lincoln Frakes was in private practice in Amsterdam, focusing on banking, commercial and energy litigation. He has served as a judge in the Amsterdam District Court and in the 's-Hertogenbosch Court of Appeal, dealing with a range of contractual, corporate and insolvency cases. He is currently a judge in the Oost-Brabant District Court (sitting by designation in the Amsterdam District Court). 

Alex Burrough

Alex Burrough is an experienced legal English translator and interpreter. He is specialised in courtroom interpreting (Dutch to English) and translation of Dutch legal texts into English. Alex was closely involved in the translation of the Dutch Code of Civil Procedure and developing the NCC Rules (English version).
